Notes on Covenants
and By-Laws
Each Mayapple Village property is subject to a set of Covenants and Restrictions which run with the land. Neither the Board of Directors nor any individual homeowner has the authority independently to alter or revoke these covenants. Each homeowner should receive and review these documents before closing on their property since the covenants are incorporated by reference into each deed of conveyance out of the original Mayapple tract. Note: The golf course property was designated “green forever” by the South Middleton Township Board of Supervisors and may not be developed.
The seller of any property located within the Mayapple Village planned residential development (PRD) should provide a copy of all such documents to the buyer. Any homeowner who does not possess copies of these documents should contact their seller, real estate agent, attorney or download them from this website. These documents are also filed at the office of the Recorder of Deeds for Cumberland County and can be obtained there.
The covenants and by-laws that apply to all property owners are: Declaration of Covenants and Restrictions (dated June 16, 1989), Supplemental Declaration of Covenants and Restrictions (October 16, 1989), By-Laws of Mayapple Village Home Owners Association, Inc. (dated May 8, 1990), Amended Declaration of Covenants and Restrictions (October 17, 1990), Amended Declaration of Covenants and Restrictions (June 21, 1996), and By-Laws of MVHOA, Inc. First Revision (November 14, 1999).
The remaining covenants apply specifically to properties on Kitszell Drive(also called Wexford patio homes), on Liberty Court (also called Prestwick townhomes) and Wiltshire West and Wiltshire East ( also called the Meadowridge Condos).
Rules and Regulations:
The HOA Board may adopt and amend rules and regulations that are not inconsistent or in conflict with the Declaration or the Bylaws and that it finds to be for the common good the development.
